Terms of service
The agreement
These terms apply between ‹Lyron AS› ("we") and the company that orders the service ("the customer"). The data processing agreement is part of the agreement. Whoever orders confirms they are authorised to bind the customer.
The service
The service plans trips for electric trucks with charging, breaks and booking, and follows the trips on the way. The plans are decision support: the driver and the customer are responsible for following the driving and rest time rules, the traffic rules and the tachograph, and for judging whether a plan is sound.
Data from others
The service relies on data from NOBIL, the Norwegian Public Roads Administration, Kartverket and the charging operators. We can't guarantee that it is correct or available. A booking in the service gives a place in the service's queue, and is a reservation with the operator only where the service shows it.
Trial and price
The first 30 days are free. After that, the price agreed with the customer applies. We invoice monthly in arrears, payable within 14 days. Price changes are announced at least 60 days ahead.
The customer's responsibility
The customer decides who gets access, and makes sure users keep their accounts to themselves. The customer is responsible for having a lawful basis for processing the drivers' data, among others under chapter 9 of the Working Environment Act.
Availability
We aim for the service to be available around the clock, and announce planned maintenance on the status page. We take backups daily and test restoring them every month.
Termination and data
Either party can terminate with 30 days' notice to the end of a month. After the agreement ends, the customer's access is closed for changes for 30 days so the customer can export its data, and then we delete it. We can close access in case of material breach, such as non-payment after notice.
Liability
Our total liability is limited to what the customer paid in the last twelve months, and we are not liable for indirect loss, unless the loss is caused by gross negligence or intent.
Governing law
Norwegian law applies. Disputes are settled by negotiation, and otherwise at the customer's home court.
